by registering with the "PayandShare" service (hereinafter referred to as "Service") and while you use the service we will collect your data ("Data" includes name or nickname, e-mail address, password, information on your device, your geographical location, the purchases/transactions in shops, restaurants, hotels etc, information on the evaluation of the Service, comments, etc, collected during registration and/or provided by you when using the service). The data will be processed in compliance with applicable laws and for the purposes listed below. “Processed” means all operations, including those performed without electronic instruments, regarding the collection, recording, organisation, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, disclosure, spreading, deletion and destruction of data.
Therefore, pursuant to art 13 of Lgs. D. 196/2003,
please be aware
that we will collect and process your data in compliance with what is listed below:
a) general purposes: your data will be processed to supply the Service and the services connected to it (including, but not limited to, data backup and recovery, sharing and dividing expenses among participants in the same event, the collection of information to return to the community of users that will register for the same service, etc), and to comply with legal obligations (including accounting, administrative, tax-related obligations etc);
b) for the purpose of sending communications and news: your (non delicate) data can be used – only with your specific, explicit, non-obligatory and freely given consent, which can be revoked at any time you wish – to send communications and/or news through the specific section of the application that accesses the Service, without prejudice to the fact that, after having expressed your consent, you have the right, at any time and at no cost to you, to oppose to the processing of your Data for this purpose
c) processing methods: your Data will be processed with paper supports/instruments and with electronic/IT/telematic instruments, in full compliance with the law and according to the principles of lawfulness and correctness and in a such way that your privacy is protected;
d) facultative provision: you are under no obligation to supply your Data;
e) consequences of refusing to provide data: if you refuse to provide us with your Data or oppose to its full processing we may be unable to provide you with the Service and to have any kind of relationship with you;
f) subjects or categories of subjects your Data may be disclosed to/spread: your Data may be disclosed – for the same purposes listed in point a), to other subjects registered with the Service and with whom you, freely and intentionally, decide to share your Data. Your Data, after being transformed into anonymous data or into a format that does not allow anyone to identify the person the data concerns, may be disclosed to our commercial partners for the correct execution of the purposes listed in point b). Your Data will not, in any case, be spread;
g) data supervisor and persons in charge of the processing: your Data will be processed solely and exclusively by a very limited number of people in charge of the processing who have been specifically authorised to do so;
h) rights of the person concerned: you have all the rights listed in art. 7 of Lgs. D. no. 196/2003, copied in full below.
Art. 7. (Right of access to personal data and other rights) 1.The person concerned has the right to obtain confirmation that personal data concerning him/her exist, even if not recorded yet, and to obtain that data in a comprehensible format. 2. The person concerned has the right to be informed about: a) the origin of the personal data; b) the purposes and methods of processing; c) the logic applied if the data is processed with the help of electronic instruments; d) the name of the data controller, data supervisors and the representative appointed pursuant to art. 5, paragraph 2; e) the subjects or categories of subjects to whom the data may be disclosed or who could obtain it if they are the appointed representative in Italy, data supervisors or people in charge of the processing. 3. The person concerned has the right to obtain: a) that the data is updated, corrected or, if in his/her interest, integrated with new data; b) the deletion, transformation into anonymous data or the blocking of data processed against the law, including data that was not necessary to keep for the purposes it was collected for or processed at a later date; c) the certification that the operations listed in points a and b (with regard to the contents as well) have been brought to the attention of those to whom the data have been disclosed, unless fulfilling this obligation is impossible or requires an effort out of proportion compared to the right. 4. The person concerned has the right to object, totally or partially a) for legitimate reasons, to the processing of personal data concerning him/her, even if pertinent to the purpose it was collected for; b) to the processing of personal data concerning him/her for the purpose of sending advertising material, direct sales, for market surveys and commercial communications;
i) data controller: the data controller is Ms Maria Giulia Gualandi, domiciled for the purpose in Funo di Argelato (BO), Via Gobetti n.4, whom you may contact to exercise the rights listed in article 7 of Lgs. D. 196/2003;
Additions (in writing or orally) may be made to this policy, with extra elements and instructions, to comply with changes in the law.
